  Jotham Burt's will Posted by Jane Peppler on Sun, 28 Mar 1999 Surname: BURT, LEONARD, FREEMAN, HAYWARD, HAYWOOD, HEYWOOD Said will is dated October 17, 1805, and filed on March 13, 1806, in the Register of Wills' Office of Fayette County, Pennsylvania, in Will book No. 1, page 160 In the name of God Amen I Jotham Burt of the township of Franklin in the County of Fayette and state of Pennsylvania, being of sound mind ... after my just debts and funeral expenses are fully paid ... I give devise and bequeath all that Tract or Parcel of Land whereon I now live Situate in Franklin Township aforesaid unto my two sons Zephaniah Burt and Daniel Burt except twenty six Acres thereof which is the real property of Zephaniah equally to be divided between them share and share alike ... the above division of said land is not to take place until after the decease of my Wife Mary Burt. I also give and bequeath unto my other two sons Joseph Burt and Ebenezer Burt the sum of twenty pounds a piece to be paid them by my sons Zephaniah and Daniel Burt within three years after my decease. I also give and bequeath unto my Daughters Sarah Leonard, Jemima Leonard and Mary Freeman, All my personal property ... to be divided between them share and share alike (Except that Sarah Leoanrd is to have a third less than the other Daughters, she having already received part of her portion thereof) ... it is my will that the entire Estate in my possession at the time of my decease shall be and remain in the sole possession of my wife Mary Burt during the term of her natural life ... and after her decease I nominate ... my Sons Joseph Burt and Ebenezer Burt Joint Executors ...
